Two Developments Highlight Momentum and Limits in Minnesota’s Cannabis Sector

Minnesota’s cannabis industry saw two notable developments within the last week, one clarifying how cities must handle license applications and another expanding consumer experiences in Carlton. Neither represents a sweeping shift in state policy, but together they illustrate how the legal and business landscape continues to evolve.

In Albert Lea, the Minnesota Court of Appeals ruled that the city improperly denied a cannabis business registration to entrepreneur Jacob Schlichter. Schlichter received a state microbusiness license on July 17, 2025, and immediately applied to open The Smoking Tree. At the time, Albert Lea’s ordinance required cannabis registrations to be issued strictly in the order applications were received, based on the timestamp of the state license.

City staff reported receiving messages criticizing Schlichter’s past, including a 2016 criminal matter and allegations of online harassment, ahead of the council’s July 28 vote. The council rejected his application 4–3. The Court of Appeals found that none of those concerns were raised during the meeting and that the city failed to follow its own first‑come, first‑served rule. The ruling doesn’t guarantee Schlichter a license under the city’s updated ordinance, but it does reinforce that municipalities must adhere to the licensing frameworks they adopt.

While the court decision focused on process, the Fond du Lac Band of Lake Superior Chippewa showcased a different kind of progress with the opening of Minnesota’s first cannabis tasting lounge behind Black Bear Casino Resort. The Anang Tasting Lounge — also the nation’s first tribally owned lounge offering solventless concentrates — blends education, sensory exploration, and on‑site consumption. Features include a solvent‑free hash lab, a guided “Dab Theatre,” and rental glassware from local artists.

Band leaders say the expansion strengthens sovereignty and positions the Fond du Lac Band as a leader in cannabis hospitality. Additional dispensaries, including one in Duluth and a mobile unit, are already planned.
